A court may order a spouse to pay the other spousal maintenance in a divorce or legal separation proceeding, if it finds that certain statutory requirements are met.  For example, a court may awarded spousal maintenance if it finds that a spouse is unable to be “self-sufficient through appropriate employment.” Spousal maintenance is sometimes referred to as alimony.  If the court finds that an award of spousal maintenance is appropriate, then it will have to determine the amount and duration of the award after considering a number of factors.  Arizona does not have a formula for determining the amount or duration of the spousal maintenance award.  Spousal maintenance may sometimes be modifiable or even terminated.  If you have questions regarding spousal maintenance and the options available to you contact us.
